Privacy & Cookie Policy
Simplyture ApS (CVR-nr. 36 95 82 43)(”Simplyture”) har udviklet en tjeneste for betaling af parkering med kreditkort ved brug af en mobiltelefon (”Tjenesten”). Parkeringens længde bliver registreret hos Simplyture via kameraer og nummerpladegenkendelse. Betaling sker via Tjenesten, Simplyture’s betalingsautomater, eller indenfor 48 timer på www.simplyture.com . Simplyture forestår betaling til ejeren eller den, som driver parkeringspladsen (”Parkeringsudbyderen”).
Disse standardvilkår gælder mellem Simplyture og enhver myndig forbruger (”Kunder”), der anvender Tjenesten, medmindre andet er skriftligt aftale mellem Simplyture og Kunden.
Brugsanvisning for tjenesten findes på www.simplyture.com . Tjenesten vil kunne benyttes på områder, som skilter med Simplyture, og som angivet på www.simplyture.com eller i Simplyture app’en.
Tjenesten vil køre i baggrunden i tilfælde, hvor mobile netværk ikke er tilgængelige.
Betaling for parkering via andre betalingsløsninger end dem tilbudt af Simplyture er Simplyture uvedkommende.
Alle juridiske enheder og myndige personer kan anvende Simplyture’s tjeneste.
Oprettelse af Simplyture konto sker ved at afgive kundeoplysninger på www.simplyture.com , eller via Simplyture app’en. Det er kundens ansvar, at de korrekte brugeroplysninger og registreringsnumre altid er registreret i Simplyture-systemet. Simplyture fraskriver sig ethvert ansvar relateret til indtastningsfejl under registreringen uanset registreringsmetode.
Efter registreringen bliver kunden bedt om at logge ind på Simplyture’s website for at verificere, at oplysningerne er registrerede, korrekte, og gyldige.
Alle kunder vil blive kreditvurderet, og kunder giver ved videregivelsen af oplysningerne tilladelse til indhentning af kreditoplysninger hos kreditoplysningsbureauer. I særlige situationer kan indbetaling af et depositum være nødvendigt for aftalens indgåelse, og Simplyture kan fastsætte kreditgrænser for de enkelte kunder. Depositum forrentes ikke. Dersom kunden ikke findes tilstrækkelig kreditværdig, kan Simplyture afvise kunden. Simplyture kan også på andet sagligt grundlag afslå en bestilling.
En Simplyture konto kan disponere over flere biler. Disse skal være registrerede i Simplyture’s database.
Kunden afgiver ved oprettelse af konto hos simplyture fuld tilladelse til at Simplyture kan hæve forbrugsbeløb hos vores tredje parter. Ønskes denne aftale opsagt, kan dette ske ved kontakt til simplyture, eller afmeldelse via Simplyture’s app eller hjemmeside (www.simplyture.com) . Hvis kunden allerede har benyttet sig af betalt parkering uden at gennemføre betalingen, gemmer Simplyture stadigvæk bruger oplysninger.
Kunden er forpligtet til selv at holde sig opdateret på de aktuelle handelsvilkår. Som kan findes på www.simplyture.com
Kunden er ansvarlig for betaling af parkeringsafgiften. Ansvaret omfatter også andres brug af kundens Simplyture konto og biler, herunder uvedkommendes brug, såfremt det ikke kan påvises, at uvedkommendes brug er muliggjort gennem uagtsomhed fra Simplyture’s side. Betaling kan foregå via Simplyture app’en, Simplyture’s betalingsautomater, eller på www.simplyture.com indenfor 48 timer af parkeringens slutning.
Kunden betaler for den indeholdte parkeringstid i henhold til de enhver tid skiltede priser i p-anlægget. Simplyture er ikke forpligtet til at informere om ændringer i parkeringsselskabets parkeringstariffer.
For parkering betales via kreditkortopkrævning, den til enhver tid gældende takst på det pågældende p-areal, prisen vil fremgå på www.simplyture.com og i Simplyture app’en. Ved foreskel imellem den oplyste pris i Simplyture’s app, eller på www.simplyture.com og parkerings anlægget er det altid den oplyste pris ved parkerings anlægget der gælder.
Alle priser er tilgængelige på www.simplyture.com .
Såfremt brugeren anvender Simplyture app’en, er det vigtigt at opdatere applikationen, således at der altid benyttes den seneste version af app’en. Hvis kunden ikke har den nyeste version af appen, har Simplyture ikke ansvar for fejl i priser eller oplyste information.
Hvis brugeren ikke får startet parkering med brug af vedkommendes Simplyture konto, er brugeren forpligtet til at benytte alternative betalingsformer. Brugeren er ikke under nogen omstændigheder fritaget fra sin pligt til at betale for sin parkering med gyldig betalingsmiddel. Parkeringen løber til bilens udkørsel fra p-anlægget. Hvis tjenesten ikke er tilgængelig, og parkeringen ønskes afsluttet, kan brugeren betale via betalingsautomaterne eller indenfor 48 timer på Simplyture’s webside.
Når en parkering påbegyndes, har kunden mulighed for at få en notifikation om parkeringstariffer for det pågældende p-anlæg, selvom betaling via Simplyture app’en foregår automatisk.
Simplytures tjeneste kan kun anvendes på p-anlæg, som er opført på en liste på Simplyture’s website, og fremgår af Simplyture’s app og som er udstyret med Simplytures skiltning på eller rundt om betalingsautomaterne. Simplyture-kunder skal følge regler og bestemmelser, som er specificerede af ethvert bystyre (kommune) og parkeringsselskab.
Hvis korrekt betaling har fundet sted, vil parkeringstransaktionen være registreret i Simplytures database. Hvis brugeren alligevel bliver opkrævet tillægsafgift, gebyr eller lignende, vil Simplyture på opfordring fra kunden attestere transaktionen overfor P-administratorerne.
Simplyture vil ikke under nogen omstændigheder være ansvarlig for betaling af kontrolafgifter, gebyrer eller lignende, som kunden er blevet påført.
Før en fejl meldes til Simplyture, bør brugeren undersøge, om fejlen skyldes brugerens eget udstyr. Kunden mister sin ret til at gøre en mangel gældende hvis han ikke giver Simplyture besked om manglen inden 60 dage efter han har opdaget eller burde have opdaget manglen.
Kunden skal friholde Simplyture for alle skader som følge af konflikter mellem kunden og parkeringsselskabet, bystyret, kreditkortvirksomheden eller mobiltelefonoperatøren.
Simplyture er ikke ansvarlig for skader eller tab, hvis:
Ingen af Parterne skal være erstatningsansvarlige for tab, der hidrører fra omstændigheder af usædvanlig art, og som hindrer, besværliggør eller fordyrer aftalens opfyldelse, såfremt disse indtræder efter aftalens indgåelse og ligger uden for parternes kontrol, herunder: Arbejdskonflikter (strejker og lockouts), ildsvåde, krig, oprør, indre uroligheder, vejrlig og naturkatastrofer, valutarestriktioner, offentlig beslaglæggelse, import- eller eksportforbud, afbrydelse af den almindelige samfærdsel, herunder energiforsyning, servernedbrud væsentlige pris- og/eller afgiftsforhøjelser, valutaudsving, produktions- og leveringsvanskeligheder, der skyldes forhold, der ikke kan bebrejdes en Part samt indtrædelse af force majeure og/eller hard ship hos relevante underleverandører.
Den part, som ønsker at påberåbe sig fritagelse fra opfyldelse af sine forpligtelser i henhold til den i ovenstående anførte undtagelsesbestemmelse, skal straks underrette den anden part skriftligt om indtræden og ophør af enhver force majeure-situation og anvende alle rimelige midler til at afbøde følgevirkningerne af det pågældende forhold for den anden part.
En berettiget fritagelse i henhold til ovenstående fritager den svigtende part for erstatningsansvar og andre kontraktlige sanktioner og udskyder endvidere tidspunktet for opfyldelsen heraf med en rimelig periode. Ved afgørelse af, hvad der i denne forbindelse er en rimelig periode, skal der tages højde for den svigtende parts evne til at genoptage opfyldelse af Aftalen på trods af forsinkelsen. Indtil aftaleydelserne genoptages, kan den anden part suspendere sin egen aftaleopfyldelse.
Ved betalingsmisligholdelse vil Simplyture oplyse personinformationer, til tredje part, som vil sende opkrævninger i henhold til rentelovens til enhver tid gældende bestemmelser. Ved betalingsmisligholdelse vil kunden blive pålagt rykkergebyr, og forsinkelsesrente efter til enhver tid gældende lovgivning.
Hvis Kunden ikke har registreret et gyldigt betalingskort hos Simplyture suspenderes muligheden for at benytte servicen. Simplyture kan også lukke tjenesten, hvis kundens kreditgrænse er oversteget, eller hvis kunden misbruger tjenesten.
Hvis kunden afregner med et kreditkort, og annullerer det træk, Simplyture har foretaget af kundens parkeringsomkostninger i forbindelse med brug af tjenesten, på Kundens kreditkort, uden først at kontakte Simplyture, anses det som væsentlig misligholdelse. Dette gælder også hvis kunden ved kortfornyelse ikke meddeler Simplyture de nye kortdata. Det er kundens ansvar at afgive nye kreditkortoplysninger mindst en (1) måned inden kreditkortet udløber.
Simplyture kan med øjeblikkelig virkning hæve aftalen ved væsentlig mislighold fra kundens side. Simplyture forbeholder sig endvidere ret til at videregive oplysninger til et kreditoplysningsbureau, hvis kunden ikke opfylder betalingsvilkårene.
Tvister mellem kunden og Simplyture skal søges løst i mindelighed.
Alle køb og andre transaktioner foretaget af forbrugere på Simplyture’s hjemmeside eller app er omfattet af dansk ret og reglerne om forbrugerbeskyttelse. Alle køb og andre transaktioner foretaget af erhvervsdrivende på Simplyture’s hjemmeside eller app er omfattet af dansk lov.
Dersom sagen ikke lader sig løse mindeligt, kan en tvist mellem forbrugere og Simplyture indbringes for Forbrugerstyrelsen eller de danske domstole. Rette værneting i tvister mellem forbrugere og Simplyture skal være retten ved forbrugerens bopæl eller Simplyture’s hjemsted.

I forbindelse med anvendelse af Tjenesten sker der behandling af personoplysninger om Kunden (herunder navn, adresse, og nummerpladeoplysninger). Behandlingen sker i overensstemmelse med persondataloven. For mere information se Simplyture’s Privacy Policy, som findes på www.simplyture.com .
Der er ingen fortrydelsesret på forbrug gennem Simplyture. Hvis du har indsigelser til udestående eller hævet beløb, bedes du kontakte det anvendte parkeringsanlæg.
Nærværende abonnementsaftale løber til den opsiges. Kunden kan til enhver tid opsige nærværende abonnementsaftale. Opsigelsesvarsel er løbende måned plus 30 dage. Eventuel opsigelse skal meddeles skriftligt til Simplyture. Aftalen kan opsiges af Simplyture ved kundens væsentlige misligholdelse.
Aftaler og betingelser kan ændres/ophøre som følge af offentlige pålæg, forskrifter eller andre forhold, som Simplyture ikke kan bære ansvaret for. Parterne er i sådanne tilfælde fritaget for deres forpligtelser.
Der kan ikke laves ændringer i kundeaftalen, selv hvis der på grund af offentlige pålæg, forskrifter eller andre udenforstående forhold, som Simplyture ikke kan bære ansvaret for, skulle medføre behov for dette. I disse tilfælde vil kunden ikke kunne benytte Simplyture’s service.
Begge parter er bekendt med, at udviklingen inden for mobile betalinger ændrer sig hurtigt.
Simplyture kan til enhver tid (i) ændre vilkårene for den aktuelle forbrugs aftale og/eller (ii) ændre en del af de tjenester, der fremgår heraf. Sådanne ændringer vil være bindende og træder i kraft tredive (30) dage efter offentliggørelse af ændringen på Simplyture hjemmeside, app eller ved underretning til kunden via e-mail.
Hvis kunden ikke vil acceptere ændringerne, kan aftalen opsiges efter ovenstående vilkår for opsigelse.
Hvis kunden fortsætter med at benytte Simplytures tjenester efter en sådan ændring, accepterer kunden at overholde og være bundet deraf.
Når en kunde tilmelder sig tjenesten, indtaster kunden fornavn, efternavn, e-mailadresse, og vælger en adgangskode. Denne e-mailadresse og adgangskode bruges til at få adgang til personlig hjemmeside www.simplyture.com eller på Simplyture’s app.
Kunden accepterer at kodeordet ikke må videregives eller skrives ned, så andre kan få adgang til oplysningerne. Kunden skal uden ugrundet ophold give meddelelse til Simplyture’s kundeservice, hvis der er grund til at antage, at en anden har fået adgang til eller viden om adgangskoden.
Kunden er ansvarlig for alle godkendte anvendelser af tjenesten. Kunden accepterer desuden uden ugrundet ophold at give Simplyture meddelelse, hvis kunden mener, at kontoen er blevet brugt af en uautoriseret person eller på en uautoriseret måde.
Såfremt kunden oplever problemer med produktet, bedes kunden sende en beskrivelse af problemet til Simplyture på e-mail til support@simplyture.com eller per post til Esplanaden 34G, 2.sal, 1263 København K.
Efter modtagelse af reklamationen sender Simplyture en e-mail til Kunden med oplysninger om den videre proces.

This policy describes how Simplyture collects and uses the personal information you provide on the Service (or that we otherwise collect in connection with the Service) as well as the data we collect with our cameras at the parking facilities. These standard terms apply between Simplyture and any authoritative consumer that uses the Service, unless otherwise written agreement between Simplyture and the consumer exists.

“Collected Data”: Data collected by us through people signing up to a Simplyture account or through pictures taken by our cameras in the parking facilities.
“Source Account Information”: Your Simplyture login and password information.

We use this information, which does not identify individual users, to analyze trends, to administer the site, to track users’ movements around the site and to gather demographic information about our user base as a whole. We do link this automatically-collected data to personally identifiable information.
The use of tracking technologies by our technology partners and other 3rd party assets on the site is not covered by our privacy policy. We do not knowingly collect or solicit personally-identifiable information from anyone under the age of 13 or knowingly allow such persons to register. Information Security
While using Simplyture’s services, all data that is transferred between your device and our Service, such as credit card information is encrypted with Secure Socket Layer (SSL) technology.
While using the Service, we never store your sensitive information such as credit card information in cookies.
We follow generally accepted standards to protect the personal information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, we cannot guarantee its absolute security.

Ownership and privacy of data
We understand that Simplyture relies on sensitive private data to be stored on our servers, and that steps must be taken to ensure this data stays private.
None of the uniquely identifiable information will be collected or shared with third parties, unless there is an outstanding debt between the customer (you), and the third party (parking facility). In which case your uniquely identifiable information, such as address, name and contact information will be shared with our third party affiliates, so that they can send an inquiry for debt collection.
Additionally, this data may be sold as a non-uniquely identifiable source of information, by congregating the aggregated information into statistical charts, or suggestions of improvements for the parking facilities, created by artificial intelligence.
Except as described herein, your specific set of Collected Data will never be disclosed, sold or shared with a third party in an identifiable and non-anonymous form, unless we conclude that it is required by law, such as to comply with a subpoena, or similar legal process; when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request, or to any other third party with your prior consent to do so.
We may also choose to buy or sell assets, and in these types of transactions, data is typically one of the transferred assets. If Simplyture is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on our Web site of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information.
To market, operate and improve our services for you and other customers, and build and operate new services and products, we reserve the right, and you hereby grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sub licensable and transferable (as set forth in this Privacy Policy and/or the Terms & Conditions found on our website) right, to use your Collected Data for such purposes.
Specifically, we will periodically access and include your Collected Data in the pool of data used by our statistical models to generate and provide estimates of app performance (e.g., downloads, revenues, etc.) across publishers, industries, geographies and marketplaces. Subscribers to our Simplyture services will never receive your specific set of Collected Data in an identifiable, non-aggregated form. You hereby acknowledge and consent to such use by using our Service.
During the conversion from identifiable data, to congregated unidentifiable data, the discrete handling will be processed by our AI. This ensures that your identifiable data will not be disclosed or processed in any form, by us(Simplyture) our services, employees, or third party affiliates, unless a subpoena is issued to justify such action. In this case, both Simplyture, and the third party affiliates (Parking facilities) will have access to your identifiable data.
For the avoidance of doubt, the estimates generated by our statistical models (and made available to others) may include performance estimates of your assets / digital goods / products that are derived from pools of information including your Collected Data. Because they are generated by our Statistical Model from pooled information and are only estimates, we consider these estimates regarding your apps to be non-identifiable, aggregated and anonymized even though (a) the estimates may be very similar to the actual performance data you provided as part of the Collected Data and (b) the estimates may specifically name each app and publisher.
Additionally, from time to time, our sales, support and engineering staff (including those of third party service providers we use authorized to carry out tasks on our behalf as described below) may log in to the Service on your account in order to provide you assistance with sales, billing or technical issues upon your request.
Furthermore, all employees of Simplyture are required to sign a Non-Disclosure Agreement(NDA) to ensure the privacy of your Collected Data and Source Account Information.
Information is also provided in certain limited circumstances to third parties to carry out tasks on our behalf for the purpose of maintaining, operating, providing and improving the Service (including without limitation, billing, emailing, processing applications, support or data storage) with strict restrictions that prevent the data from being used or shared except as directed by us. When third parties are carrying out these tasks on our behalf, they are subject to agreements that oblige them to process such information only on our instructions and in compliance with this Policy and to undertake appropriate confidentiality and security measures. These companies are authorized to use your personal information only as necessary to provide these services to us. You hereby acknowledge and consent to such use by using our Service.
We will retain your information for as long as your account is active or as needed to provide you services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. If your personal information changes, or if you no longer desire our service, you may correct, update, amend, delete or remove your stored information such as credit card information, license plate, and car model/make through your personal page in the Simplyture app, or by emailing our Customer Support at support@simplyture.com or by contacting us by postal mail at the contact information listed at the end of this privacy policy disclosure.
We will upon request delete your account and associated account information (such as your contact details, email addresses and Source Account Information). While we will immediately cease collection of your Collected Data upon deletion of your account, any of your previously Collected Data that has already been included in the pool of data used by our Simplyture Statistical Model will not be deleted.
Opt-out preferences
If you wish to subscribe to our newsletter(s), we will use your name and email address to send the newsletter to you. Out of respect for your privacy, you may choose to stop receiving our newsletter or marketing emails by following the unsubscribe instructions included in these emails, accessing the email preferences in your account settings page or you can contact us at support@simplyture.com .
Links to 3rd party sites
Our Site includes links to other Web sites whose privacy practices may differ from those of Simplyture. If you submit personal information to any of those sites, your information is governed by their privacy policies. We encourage you to carefully read the privacy policy of any Web site you visit.

Policy Updates
